On Monday, June 15, 2020, the U.S. Supreme Court ruled 6-3 that Title VII of the Civil Rights Act prohibits discrimination against LGBT individuals. This means an employer cannot discriminate against an employee for their sexual orientation or gender identity. This is in addition to the existing Title VII, which bars employers from discriminating against employees on the basis of sex as well as race, color, national origin and religion.
On Friday, June 12, 2020, the Trump Administration overturned a 2016 Obama Administration rule that banned discrimination against patients based on gender identity. The new ruling allows employers to remove health care coverage protections for transgender individuals from their health plans.
Penn State Health will continue to offer coverage for transgender employees and covered dependents despite this ruling.
