Penn State Health policy gives guidance on legal drugs

Penn State Health’s Medicine Use Policy provides guidelines for the acceptable and unacceptable use of legal prescription and over-the-counter medicine. The policy, HR46, applies to all Penn State Health employees, candidates for employment, volunteers and temporary/contract personnel.

The policy does NOT apply to the College of Medicine. However, if you are a College of Medicine employee and supervise Penn State Health employees, please familiarize yourself with the policy and disclosure requirements.

Highlights of Penn State Health HR46:

  • Any employee using a prescribed legal or over-the-counter drug which may affect the ability to safely and efficiently perform any job duty is required to report it to his or her supervisor immediately.
  • Any supervisor who has been informed or has reason to believe that an employee is using a prescribed legal or over-the-counter drug that may affect the employee’s ability to perform job duties safely and efficiently, shall report this information to human resources.
  • Any employee using a prescribed legal or over-the-counter drug which may affect the ability to safely and efficiently perform any job duty may be required to obtain a “fit for duty” clearance from health care provider.
  • In those circumstances where the use of a prescribed or over-the-counter drug is inconsistent with the safe, efficient performance of job related duties, management may take appropriate measures, including reassigning the employee, modifying job responsibilities, or requiring the employee to take paid time off or a leave of absence.
